DMCA Copyright Infringement Takedown Notice

Overview

Quantum Navigator (“we,” “our,” or “us”) respects the intellectual property rights of others and expects our users to do the same. We comply with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, and will respond to proper notices of copyright infringement.

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on our website, you may notify our designated DMCA agent by following the procedures outlined below.


What is DMCA?

The Digital Millennium Copyright Act (DMCA) is a United States copyright law that provides a process for copyright owners to request removal of content they believe infringes their copyright.

Under the DMCA:

  • Service providers must respond to valid notices by removing or disabling access to the material
  • Users can submit counter-notifications if they believe content was removed in error

Filing a DMCA Takedown Notice

If you believe content on Quantum Navigator infringes your copyright, please send a written notification to our designated DMCA Copyright Agent.

Required Information

To be valid under the DMCA (17 U.S.C. § 512(c)(3)), your takedown notice must include all of the following:

1. Identification of the Copyrighted Work

Identify the copyrighted work you claim has been infringed. If multiple copyrighted works are covered by a single notification, you may provide a representative list.

Example: “The copyrighted work is my article titled ‘Quantum Computing Innovations 2025’ originally published on [URL].”

2. Identification of Infringing Material

Identify the material on our website that you claim is infringing and provide information reasonably sufficient to permit us to locate the material.

Example: “The infringing material is located at https://quantum.org.uk/company/example-company/"

Please provide:

  • Exact URL(s) of the infringing content
  • Description of where the content appears on the page
  • Screenshots if helpful

3. Your Contact Information

Provide information that allows us to contact you:

  • Full legal name
  • Mailing address
  • Telephone number
  • Email address

4. Good Faith Statement

Include the following statement:

“I have a good faith belief that use of the copyrighted material described above is not authorized by the copyright owner, its agent, or the law.”

5. Accuracy Statement

Include the following statement:

“I swear, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.”

6. Signature

Provide your physical or electronic signature.

Electronic signatures are acceptable and include:

  • Typed full name: “/s/ [Your Name]”
  • Scanned handwritten signature
  • Digital signature

Our Response Process

When we receive a valid DMCA takedown notice, we will:

  1. Review the Notice: Verify it meets all DMCA requirements
  2. Remove or Disable Access: Promptly remove or disable access to the allegedly infringing material
  3. Notify the User: If applicable, notify the user who posted the content
  4. Document: Maintain records as required by law

Response Time: We aim to respond to valid DMCA notices within 3-5 business days.


Counter-Notification (If Your Content Was Removed)

If you believe material you posted was removed or disabled by mistake or misidentification, you may file a DMCA counter-notification.

Requirements for Counter-Notification

Your counter-notification must include:

1. Identification of Material

Identify the material that was removed or disabled and the location where it appeared before removal.

Example: “The material removed was my company description at https://quantum.org.uk/company/my-company/"

2. Your Contact Information

Provide:

  • Your full legal name
  • Address
  • Phone number
  • Email address

Include the following statement:

“I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located (or the federal district courts located in [specify jurisdiction] if my address is outside of the United States), and I will accept service of process from the person who provided the original DMCA notification or an agent of such person.”

4. Good Faith Statement

Include the following statement:

“I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.”

5. Signature

Provide your physical or electronic signature.

Counter-Notification Process

  1. Send to DMCA Agent: Email your counter-notification to dmca@quantumzeitgeist.com
  2. We Forward to Complainant: We will send a copy of your counter-notification to the original complainant
  3. Waiting Period: The complainant has 10-14 business days to file a court action
  4. Restoration: If no legal action is filed, we may restore the content after 10-14 business days

Warning: Filing a false or fraudulent counter-notification may result in legal consequences, including liability for damages, court costs, and attorneys’ fees.


Repeat Infringer Policy

Quantum Navigator has a policy of terminating, in appropriate circumstances, access for users who are repeat copyright infringers.

Repeat Infringer Definition: A user who has received multiple valid DMCA takedown notices or has been found liable for copyright infringement.

Consequences:

  • First offense: Content removal
  • Repeat offenses: Account termination (if applicable)
  • Persistent violations: Permanent ban from submitting content

Misrepresentation and False Claims

Filing a DMCA notice or counter-notification with false information is illegal under 17 U.S.C. § 512(f).

Penalties for false claims:

  • Damages (including costs and attorneys’ fees)
  • Criminal perjury charges (18 U.S.C. § 1621)
  • Civil liability for misrepresentation

Warning: Only file a DMCA notice if you are the copyright owner or authorized to act on behalf of the owner. Only file a counter-notification if you genuinely believe the content was removed in error.


What We Are NOT Responsible For

Quantum Navigator is a directory and informational website. We:

  • Do not host user-generated content (beyond occasional submissions)
  • Do not control content on third-party websites we link to
  • Are not liable for copyright infringement by third parties

Third-Party Websites: If the infringing content is on a company’s own website that we link to, you must contact that company directly. We can only remove descriptions or references on our site.

Fair Use: Some uses of copyrighted material may be protected under fair use (17 U.S.C. § 107). We reserve the right to refuse takedown requests for content we believe is lawful fair use.


While the DMCA is a US law, we respect copyright laws internationally.

International Copyright Holders:

  • You may file a DMCA notice even if you are located outside the United States
  • Provide equivalent information required under your local copyright law
  • Specify your jurisdiction and applicable law
